Hami Intermediate Court issued a judicial proposal to regulate the use of agricultural UAVs

Recently, the Hami Intermediate People’s Court issued the No. 1 judicial proposal in 2023 to the local people’s governments of all districts and counties in response to the case of UAV spraying pesticide, to prevent and reduce disputes caused by UAVs from the source.

In recent years, the popularization and application of UAV spraying pesticide application technology in Hami City has been increasing, but many new types of contradictions and disputes have been caused due to the non-standard management and use of UAVs.

The judicial suggestions issued by the Hami Intermediate People’s Court start with strengthening training management, industry supervision, and publicity and guidance, and put forward five specific suggestions.

Among them, it is determined that relevant functional departments should strengthen professional training for UAV operators and strictly abide by operating procedures. Punishments shall be taken in time for illegal operation of UAVs for commercial activities; Relevant functional departments should strengthen the professional knowledge training of agricultural law enforcement personnel, strengthen the supervision and management responsibilities, guide farmers to use drugs correctly, and prevent illegal operations. For the problems reflected in the acceptance of the report, the law enforcement procedures should be performed in accordance with the law and regulations, and the evidence of infringement subject, causation, loss and other aspects should be fixed in time to facilitate the settlement of subsequent disputes; The people’s governments of all towns and townships should strengthen publicity, help farmers in the area to strengthen their legal awareness, review the qualification of UAV operators, guide the signing of written contracts, clarify rights and obligations, and perform the neighboring notification responsibilities.
